Ferguson Barristers LLP is a Personal Injury and Litigation law firm founded by Rod Ferguson, Q.C. in 1990. The firm has been built on a mission of service and of fulfilling the needs of people of every walk in life. Our lawyers serve as counsel to Law Firms and practitioners in over 35 communities throughout Ontario . A large percentage of the firm’s clients are referred by sole practitioners and small firms in the referring solicitor communities across the province. Clients are met in their own local lawyer’s office. Ferguson Barristers recognizes that to properly serve these communities, our lawyers must be willing to tackle all measures of claims, from the most catastrophic injury case to disputes which, to the client are very important matters of principle, but may not involve huge amounts of money.
Rod has recruited a team of lawyers who all share the strongest devotion to the interests of the client. Our clients matter to us, and are not regarded as a mere inventory of work in process. We cater to clients regardless of their means. We offer a no obligation consultation, and at this initial consultation, we will take as long as is required to understand the prospective client’s problem and outline what we can do to help, how long it will or may take and what the financial outcome might be.
Our philosophy is to prepare a case as if it is certain to go to court. The result is that in a very high percentage of cases we take on, the adversaries recognize our preparedness and make sensible overtures to settlement. Clients are usually happy that this strategy has “kept them out of court” and brings an early, fair resolution of their claim without the cost and anxiety of protracted legal proceedings.

One might question how it is that a Personal Injury law firm as small as ours is able to compete successfully with the large law firms in Toronto and outside of Toronto who also do litigation work. Ferguson, the firm has gained a reputation for fighting hard while conducting itself with complete fairness and integrity. The experience of the senior partner in the firm is used to good effect through a process of ongoing discussion and consultation amongst the lawyers in the firm. The firm practices an “open door” policy whereby even the most junior lawyers in the firm have ready access to the most senior lawyer.

Ferguson Barristers LLP has developed an enviable record of success both in and out of court. Our philosophy is to prepare a case as if it is certain to go to court. In appropriate cases, we use our strong negotiation skills to resolve disputes by way of settlement without trial, if that can be reasonably achieved. Indeed, we use a wide range of alternative dispute resolution techniques as soon as appropriate and practical with a view to resolving claims quickly and cost effectively.

Our firm has also achieved success in the competitive environment of litigation by providing a higher and more efficient level of service than other firms are able to provide. Our telephone calls are answered promptly. Reports to our clients are regular and are sent very quickly after events such as examinations for discovery, pre-trial conferences, mediation, pre-hearing discussions, etc. In addition, we make recommendations with regard to claim handling techniques, which we feel, can be used to optimize our clients' position in any given claim. These recommendations are made following receipt and review of the new file and as the claim evolves.

Fees
Our firm offers a highly competitive level of fees. We ensure that our fees are not only competitive as to the hourly rate, but more importantly that there is a high level of efficiency in terms of the use of time.
With our network of satellite offices and space sharing arrangements, we are able to service clients from Kitchener to New Liskeard and Owen Sound to Ottawa without the extra travel costs usually associated with Toronto Counsel.
Hourly billing rates are established for lawyers on the basis of the seniority and the experience of the lawyer.
It is not uncommon that more than one lawyer will be involved in the handling of any given case. This permits certain aspects of a matter to be handled by an associate lawyer or by a student, at a lower cost to the client. In the event that we come to the conclusion that a particular file requires the involvement of more than one lawyer working on the same aspect of a case, we will consult with you and ensure that your approval is obtained.

There are many factors that affect the level of benefits, the length of the benefit period and any extra benefits for which you may qualify. Insurance companies have time limitations for filing claims and they also have the right to have their medical specialists evaluate your injuries. When involved in a motor vehicle accident you are required to apply for accident benefits before you can sue the other driver for damages. Our lawyers and clerks have the expertise to deal with insurance companies and to sort through the Statutory Benefit Applications that are required.

Real Estate Litigation
Problems can arise with Real Estate purchases and sales that can cause financial hardship or loss. An Agreement to Purchase is a contract and both parties are obliged to live up to the obligations of that contract. Our lawyers have the litigation expertise to protect your rights.
Estate Litigation
When a loved one dies it is not only a sad and traumatic experience, but it can also be confusing and overwhelming for the beneficiaries of the Estate.
